1. Introduction and Acceptance
Welcome to JoblockPro. These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you β whether an individual or an entity β ("you," "your," "Customer," "Contractor," or "User") and JoblockPro ("Company," "we," "us," or "our").
JoblockPro operates the website located at www.joblockpro.com (the "Site") and provides an all-in-one growth automation platform built exclusively for home services contractors, including all associated features, tools, applications, integrations, onboarding services, and support (collectively, the "Service" or "Platform").
By accessing our Site, creating an account, subscribing to a plan, booking a demo, or otherwise using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must not access or use the Service.
If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" and "your" will refer to that entity.
2. Eligibility
To use JoblockPro, you must:
Be at least 18 years of age
Be a legally authorized representative of a home services contracting business (or related business)
Have the legal capacity and authority to enter into a binding agreement
Reside in or operate a business in a jurisdiction where the use of our Service is not prohibited by law
Provide accurate, current, and complete registration information
We reserve the right to refuse service to anyone, for any reason, at any time, including but not limited to exceeding our monthly onboarding capacity (currently limited to 10 new contractors per month).
3. Account Registration and Security
3.1 Account Creation
To access the Service, you must create an account by providing accurate and complete information, including your name, business name, email address, phone number, and billing information.
3.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account, whether or not authorized by you.
You must immediately notify us at [email protected] if you become aware of any unauthorized use of your account or any other breach of security.
You may not share, transfer, or assign your account to another party without our prior written consent.
3.3 User Seats
Depending on your subscription plan:
Starter Plan: Up to 2 Users
Pro Plan: Up to 5 Users
Elite Plan:Unlimited Users
Each user must have a unique login. Sharing credentials among multiple individuals is prohibited.
3.4 Account Accuracy
You agree to keep your account information current and accurate at all times. Failure to do so may result in your inability to access the Service or our inability to contact you with important service-related information.
4. Description of Service
JoblockPro provides a comprehensive automation platform for home services contractors, including but not limited to:
4.1 Core Features (All Plans)
Speed-to-Lead Response: Automatic SMS and email responses to inbound leads within 60 seconds from website forms, Facebook ads, Google ads, and phone calls
Missed Call Text-Back: Automated text responses to missed phone calls
Appointment Booking & Reminders: Online scheduling synced with Google Calendar, with automated confirmation messages and multi-stage reminders (24-hour, 2-hour, and 15-minute)
No-Show Follow-Up: Automated follow-up with rescheduling links for missed appointments
Review Request Automation: Automated post-service review requests with smart routing (positive experiences directed to Google, negative experiences directed to you first)
Review Monitoring: Real-time alerts for new Google reviews
Sales Pipelines: Lead and job tracking pipelines
Funnels/Websites: Landing page and website builder
Reporting: Basic or advanced reporting depending on plan
Internal Alerts: Notifications to your team when a lead requires immediate follow-up

4.4 Onboarding and Setup
Our team personally builds and configures your complete automation system during the first 7 days of your subscription.
Onboarding includes configuration of lead response automations, appointment booking, review generation, customer follow-up workflows, and all features included in your plan.
We limit onboarding to 10 new contractors per month to ensure white-glove setup quality.
Your active participation may be required during onboarding (providing business information, granting platform access, approving messaging templates, etc.).
4.5 Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We reserve the right to perform scheduled maintenance, during which the Service may be temporarily unavailable. We will make reasonable efforts to provide advance notice of scheduled downtime.
5. Subscription Plans and Pricing

5.2 Pricing Terms
All prices are quoted in United States Dollars (USD).
Pricing is subject to change with 30 days' prior written notice to existing customers. Price changes will take effect at the start of your next billing cycle following the notice period.
The one-time setup fee is due upon initial subscription and is non-refundable after your onboarding setup has commenced (except as provided under Section 7, 30-Day Money-Back Guarantee).
Monthly subscription fees are billed in advance on a recurring monthly basis from the date of initial subscription activation.
5.3 Additional Usage Costs
Certain Service features involve third-party usage costs that are not included in your monthly subscription fee:
SMS/Text Messages: Charged per message sent/received at prevailing carrier rates (rates will be disclosed during onboarding and in your billing dashboard)
Phone/Voice Minutes: Charged per minute for outbound/inbound calls at prevailing rates
Email Sends: A reasonable volume of email sends is included in your plan. Excessive usage beyond your plan's allocation may incur additional charges.
AI/Conversation AI Usage: Usage beyond included allocations may incur additional charges at published per-interaction rates.
You will be notified within the platform or via email before any usage charges that exceed your plan's included allocations. It is your responsibility to monitor your usage through your billing dashboard.
5.4 Plan Upgrades and Downgrades
Upgrades: You may upgrade your plan at any time. The new plan rate will be prorated and take effect immediately.
Downgrades: You may downgrade your plan at any time. The downgrade will take effect at the start of your next billing cycle. If your current data (contacts, users, workflows, funnels) exceeds the limits of the lower plan, you will be required to reduce your usage before the downgrade takes effect. We are not responsible for data loss resulting from downgrades.
6. Payment Terms
6.1 Payment Method
You must provide a valid credit card, debit card, or other accepted payment method at the time of registration. You authorize JoblockPro (or our third-party payment processor) to charge your payment method for all fees incurred under your account.
6.2 Billing Cycle
Subscription fees are billed monthly in advance on the same calendar date as your initial subscription (or the nearest available date).
Usage-based charges (SMS, phone, AI) are billed monthly in arrears and appear on your next invoice.
6.3 Failed Payments
If a payment fails:
We will attempt to process the payment again within 3 business days.
We will notify you via email of the failed payment.
If payment is not successfully processed within 7 days of the initial failure, we reserve the right to suspend your account and pause all automated services (lead response, reminders, review requests, etc.).
If payment remains outstanding for 30 days, we reserve the right to terminate your account.
During any suspension, your leads will not be responded to, your automations will not run, and your customers will not receive scheduled communications. We are not responsible for any lost leads, missed appointments, or business impact during suspension.
6.4 Taxes
All fees are exclusive of applicable taxes (sales tax, VAT, GST, etc.). You are responsible for all applicable taxes related to your use of the Service, excluding taxes based on JoblockPro's net income.
6.5 Disputed Charges
If you believe any charge is incorrect, you must contact us at [email protected] within 30 days of the charge. Failure to dispute a charge within this period constitutes your acceptance of the charge.
7. 30-Day Money-Back Guarantee
7.1 Guarantee Terms
We offer a 30-Day Money-Back Guarantee to all new subscribers:
If you are not completely satisfied with the Service within the first 30 days from your initial subscription activation date, you may request a full refund.
The refund includes your monthly subscription fee and your one-time setup fee.
The refund does not include:Usage-based charges already incurred (SMS, phone minutes, AI usage)Third-party integration costsAny charges incurred after the 30-day guarantee period
7.2 How to Request a Refund
To request a refund under this guarantee:

Include your account name, business name, and reason for cancellation
The request must be received within 30 calendar days of your initial subscription activation date
7.3 Processing
Approved refunds will be processed within 10 business days to your original payment method. Upon refund processing, your account will be cancelled and all automations will be deactivated.
7.4 Limitations
The 30-Day Money-Back Guarantee is available once per customer/business entity.
It does not apply to plan renewals, upgrades, or re-subscriptions.
Accounts terminated for violation of these Terms are not eligible for the guarantee.
Cancellation takes effect at the end of your current billing cycle. You will continue to have access to the Service until then.
No refunds are provided for partial billing periods (except under the 30-Day Money-Back Guarantee).
Upon cancellation, all automated services (lead response, reminders, review requests, reactivation campaigns) will cease at the end of your billing cycle.
You will have 30 days after cancellation to export your data (contacts, conversation history, reports). After 30 days, your data will be permanently deleted within 90 days in accordance with our Privacy Policy.
There are no early termination fees, cancellation penalties, or long-term contract obligations.
8.2 Termination by JoblockPro
We reserve the right to suspend or terminate your account, immediately and without prior notice, if:
You breach any provision of these Terms
You fail to make payment within 30 days of a failed payment attempt
You engage in fraudulent, abusive, or illegal activity
You use the Service to send spam, harass individuals, or violate any laws
You misrepresent your identity, business, or authority
Your use of the Service poses a security risk or threatens the integrity of our platform
We are required to do so by law or legal process
We discontinue the Service entirely (with reasonable notice)
In the event of termination for cause, no refund will be provided for any prepaid fees.
8.3 Effect of Termination
Upon termination or cancellation:
Your right to access and use the Service immediately ceases (or at the end of your billing cycle, as applicable)
All automated communications sent on your behalf will stop
Your login credentials will be deactivated
Data export will be available for 30 days post-termination (except in cases of termination for illegal activity, in which case we may retain data as required by law)
Sections of these Terms that by their nature should survive termination will survive, including but not limited to: Sections 10 (Your Responsibilities), 11 (Intellectual Property), 13 (Limitation of Liability), 14 (Indemnification), 15 (Dispute Resolution), and 18 (General Provisions)
9. Free Demo
9.1 Demo Terms
We offer a free, no-obligation 15-minute demo where we walk you through the JoblockPro platform customized for your specific business.
The demo is for informational and evaluation purposes only.
Booking a demo does not create a subscription or any financial obligation.
Information you provide during the demo booking and call will be used in accordance with our Privacy Policy.
Demo availability is subject to our onboarding capacity and team scheduling.
9.2 No Obligation
The demo creates no obligation to purchase, subscribe, or continue any relationship with JoblockPro. We will not charge you for a demo under any circumstances.
10. Your Responsibilities and Acceptable Use
10.1 Compliance with Laws
You agree to use the Service in compliance with all applicable federal, state, local, and international laws and regulations, including but not limited to:
Telephone Consumer Protection Act (TCPA): You must obtain proper prior express written consent before sending automated text messages or making automated phone calls to your customers through the Service. You are solely responsible for TCPA compliance.
CAN-SPAM Act: All commercial emails sent through the Service must comply with CAN-SPAM requirements, including accurate headers, honest subject lines, valid physical address, and functional opt-out mechanisms.
State Privacy Laws (CCPA/CPRA, VCDPA, CPA, CTDPA, etc.): You must comply with applicable state privacy laws regarding the personal information of your customers.
GDPR and International Laws: If you serve customers in the EU/EEA/UK, you must comply with applicable data protection laws.
FTC Regulations: All marketing materials, testimonials, and claims must comply with FTC truth-in-advertising standards.
State Contractor Licensing Laws: You must maintain all required licenses and permits for your trade and jurisdiction.
Do Not Call Registry Compliance: You must scrub contact lists against the National Do Not Call Registry as required by law.
10.2 Prohibited Uses
You agree NOT to use the Service to:
Send unsolicited commercial messages ("spam") to individuals who have not provided consent
Send messages to numbers on the Do Not Call Registry without an applicable exemption
Misrepresent your identity, business name, or the origin of communications
Send threatening, harassing, defamatory, obscene, or otherwise objectionable content
Transmit malware, viruses, or any harmful code through the platform
Attempt to gain unauthorized access to JoblockPro's systems, other users' accounts, or any connected third-party services
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
Use the Service for any purpose other than the operation and growth of a legitimate home services contracting business
Resell, sublicense, or redistribute the Service (or any part thereof) to third parties without our prior written consent
Scrape, data-mine, or use automated tools to extract data from the Platform beyond its intended functionality
Circumvent any usage limits, security measures, or access controls
Use the Service in any manner that could damage, disable, overburden, or impair the Service
Violate any applicable law, regulation, or third-party rights
Use the Conversation AI feature to deceive consumers into believing they are communicating with a human when required by law to disclose AI involvement
Upload or transmit data that you do not have the right to collect, use, or share
10.3 Content Responsibility
You are solely responsible for all content, data, messages, and materials you create, upload, send, or distribute through the Service ("Your Content").
You represent and warrant that Your Content does not violate any law, regulation, or third-party rights (including intellectual property, privacy, and publicity rights).
We do not pre-screen Your Content but reserve the right to review and remove any content that violates these Terms.
10.4 Customer Data Responsibility
As described in our Privacy Policy, you are the data controller of all Contractor Customer Data you upload, import, or collect through the Service.
You are responsible for obtaining all necessary consents and authorizations from your customers before entering their information into the platform and before sending them automated communications.
You must honor all opt-out requests from your customers promptly. JoblockPro provides opt-out management tools (e.g., STOP keyword processing for SMS), but the ultimate responsibility for compliance rests with you.
You must maintain accurate and up-to-date customer records and remove invalid or outdated information as appropriate.
10.5 Messaging Best Practices
To maintain high deliverability and compliance, you agree to:
Only message individuals who have provided consent to receive communications from your business
Identify your business clearly in all automated messages
Avoid excessive messaging frequency that could be perceived as harassment
Use accurate, non-deceptive subject lines and message content
Include required disclosures (e.g., "Msg & data rates may apply" for SMS)
11. Intellectual Property
11.1 JoblockPro IP
The Service, including all software, code, algorithms, designs, interfaces, text, graphics, logos, icons, images, audio, video, data compilations, automation workflows, templates, and all other components ("JoblockPro IP"), is and remains the exclusive property of JoblockPro and its licensors.
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes during the term of your active subscription, subject to these Terms.
You may not:
Copy, modify, distribute, or create derivative works of the JoblockPro IP
Use JoblockPro's trademarks, logos, or branding without prior written consent
Remove, obscure, or alter any proprietary notices or labels on the Service
11.2 Your Content and Data
You retain all ownership rights to Your Content and Contractor Customer Data. By uploading content to the Service, you grant JoblockPro a limited, non-exclusive, worldwide, royalty-free license to use, store, process, transmit, and display Your Content solely as necessary to:
Provide and operate the Service
Fulfill your automation and communication instructions
Improve and develop the Service (using only anonymized, aggregated data)
This license terminates when you delete Your Content or when your account is terminated, subject to our data retention policy.
11.3 Feedback
If you provide suggestions, ideas, feedback, or recommendations regarding the Service ("Feedback"), you hereby assign to JoblockPro all rights, title, and interest in such Feedback. We may use Feedback for any purpose without obligation or compensation to you.
11.4 Testimonials and Case Studies
If you provide a testimonial, participate in a case study, or authorize the use of your business results (e.g., revenue increases, review growth statistics), you grant JoblockPro a non-exclusive, perpetual, royalty-free license to use your name, business name, likeness, testimonial content, and reported results in our marketing materials, website, social media, and advertising. You may revoke this license at any time by contacting us in writing, after which we will cease use within a reasonable timeframe (not to exceed 30 days).
12. Third-Party Services and Integrations
12.1 Third-Party Platforms
The Service integrates with various third-party platforms, including but not limited to:
Google (Calendar, Business Profile, Ads, Analytics)
Facebook/Meta (Ads, Messenger)
Stripe or other payment processors
SMS/telephony providers (e.g., Twilio or equivalent)
Email delivery services
AI/NLP providers
12.2 Third-Party Terms
Your use of third-party integrations is subject to the terms, conditions, and privacy policies of those third parties. JoblockPro is not responsible for the performance, availability, security, or policies of any third-party service.
12.3 Integration Authorization
By connecting a third-party service to JoblockPro, you:
Authorize JoblockPro to access, retrieve, and transmit data to and from that service as necessary to provide the integrated features
Represent that you have the authority to grant such access
Acknowledge that disconnecting an integration may cause certain features to stop functioning
12.4 No Endorsement
JoblockPro's integration with a third-party service does not constitute an endorsement of that service. We make no warranties regarding the reliability, accuracy, or security of third-party services.
13. Limitation of Liability
13.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
The Service will be uninterrupted, timely, secure, or error-free
The results obtained from the Service will be accurate, reliable, or meet your expectations
Any specific revenue increase, lead conversion rate, review count, or business outcome will be achieved
All leads will be responded to within 60 seconds under all circumstances (response times may vary due to carrier delays, system load, or third-party service availability)
SMS/email messages will be delivered successfully (delivery depends on carrier networks, recipient settings, and other factors beyond our control)
13.2 Performance Metrics Disclaimer
All performance statistics cited in our marketing materials (e.g., "38% average revenue increase," "less than 60 seconds average lead response time," "no-show rates reduced to 4%," "3.2x more Google reviews") represent averages across our customer base and are provided for informational purposes only. Individual results will vary based on factors including but not limited to: your trade type, market conditions, geographic location, lead volume, pricing, service quality, customer base, and your active engagement with the platform.
These statistics are not guarantees of specific results.
13.3 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JOBLOCKPRO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR:
(A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Loss of profits, revenue, or business opportunities
Loss of data or data corruption
Loss of goodwill or reputation
Cost of procurement of substitute services
Lost leads or missed customer communications
Business interruption
Damages resulting from unauthorized access to or alteration of your data
(B) ANY DAMAGES ARISING FROM:
Your inability to use the Service
Any unauthorized access to or use of our servers or your personal information
Any interruption or cessation of transmission to or from the Service
Any bugs, viruses, or other harmful components transmitted through the Service by third parties
Any errors, omissions, or inaccuracies in any content
Third-party service outages or failures
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT JOBLOCKPRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13.4 Maximum Liability Cap
IN ANY EVENT, JOBLOCKPRO'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO JOBLOCKPRO IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIVE HUNDRED DOLLARS ($500).
13.5 Basis of the Bargain
YOU ACKNOWLEDGE THAT THE LIMITATIONS OF LIABILITY IN THIS SECTION ARE A FUNDAMENTAL ELEMENT OF THE AGREEMENT BETWEEN YOU AND JOBLOCKPRO AND THAT JOBLOCKPRO WOULD NOT PROVIDE THE SERVICE WITHOUT THESE LIMITATIONS.
13.6 Jurisdictional Variations
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.
14. Indemnification
14.1 Your Indemnification Obligations
You agree to indemnify, defend, and hold harmless JoblockPro, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
Your use of the Service, including all automated communications sent on your behalf
Your Content and Contractor Customer Data
Your violation of these Terms
Your violation of any applicable law or regulation, including but not limited to TCPA, CAN-SPAM, CCPA/CPRA, GDPR, and state telemarketing laws
Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
Claims from your customers related to automated messages, calls, emails, or other communications sent through the Service on your behalf
Your failure to obtain proper consents from your customers for automated communications
Any misrepresentation you make regarding your business, services, or authority
14.2 Indemnification Process
We will:
Promptly notify you of any claim subject to indemnification
Provide reasonable cooperation in the defense of such claim (at your expense)
Allow you to control the defense and settlement of such claim, provided that you may not settle any claim that imposes obligations on JoblockPro without our prior written consent
15. Dispute Resolution
15.1 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to contact us at [email protected] and attempt to resolve the dispute informally for a period of at least 30 days. Most disputes can be resolved quickly and amicably through direct communication.
15.2 Binding Arbitration
IF THE DISPUTE IS NOT RESOLVED INFORMALLY WITHIN 30 DAYS, BOTH PARTIES AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules.
Arbitration Terms:
Arbitration shall take place in [Your City, State] or, at the election of the claimant, may be conducted virtually/telephonically.
The arbitration shall be conducted by a single arbitrator with experience in technology and SaaS disputes.
The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines otherwise.
The arbitration shall be conducted in English.
15.3 Class Action Waiver
YOU AND JOBLOCKPRO AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
15.4 Exceptions to Arbitration
Notwithstanding the above, either party may:
Seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights
Bring claims in small claims court, if eligible
Report violations to applicable regulatory or law enforcement agencies
15.5 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions. To the extent that litigation is permissible under these Terms, both parties consent to the exclusive jurisdiction and venue of the state and federal courts located in [Your County, State].
16. Communications from JoblockPro
16.1 Service Communications
By creating an account, you consent to receive communications from JoblockPro related to your account and the Service, including:
Account notifications and security alerts
Billing and payment confirmations
Onboarding updates and setup progress
System maintenance and downtime notices
Feature updates and product announcements
Support responses
These transactional/service communications are essential to the operation of your account and cannot be opted out of while your account is active.
16.2 Marketing Communications
We may also send you marketing communications (newsletters, growth tips, feature promotions, webinar invitations). You may opt out of marketing communications at any time by:
Clicking the "Unsubscribe" link in any marketing email
Opting out of marketing communications does not affect transactional/service communications.
17. Modifications to the Service and Terms
17.1 Service Modifications
We reserve the right to modify, update, enhance, or discontinue any feature or functionality of the Service at any time. We will provide reasonable notice of material changes that significantly affect your use of the Service.
If we discontinue the Service entirely, we will provide at least 60 days' notice and offer a prorated refund for any prepaid, unused subscription fees.
17.2 Terms Modifications
We may update these Terms from time to time. When we make material changes:
We will update the "Last Updated" date at the top of these Terms
We will notify you via email and/or a prominent notice on our Site at least 30 days before material changes take effect
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes
If you do not agree to the updated Terms, you must discontinue use of the Service and cancel your subscription before the effective date
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy and any plan-specific terms or addenda agreed to in writing, constitute the entire agreement between you and JoblockPro regarding the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
18.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
18.3 Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. JoblockPro's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
18.4 Assignment
You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. JoblockPro may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets. Any attempted assignment in violation of this section is void.
18.5 Force Majeure
JoblockPro shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of God, war, terrorism, pandemics, epidemics, government actions, power outages, internet or telecommunications failures, carrier outages, cyberattacks, labor disputes, or third-party service provider failures.
18.6 Independent Contractors
The relationship between you and JoblockPro is that of independent contractors. Nothing in these Terms creates a partnership, joint venture, employment, franchise, or agency relationship.
18.7 No Third-Party Beneficiaries
These Terms are for the sole benefit of you and JoblockPro and do not create any third-party beneficiary rights. Your customers do not acquire any rights under these Terms.
18.8 Headings
Section headings are for convenience only and do not affect the interpretation of these Terms.
18.9 Notices
All notices under these Terms shall be in writing and shall be deemed delivered:
If by email: upon confirmed delivery
If by mail: 5 business days after deposit in U.S. mail, certified, return receipt requested

Notices to you: To the email address and/or physical address associated with your account.
18.10 Export Compliance
You agree not to export or re-export the Service or any data obtained through the Service in violation of any applicable export control laws or regulations of the United States or any other jurisdiction.
19. Special Provisions for SMS/Telephony
Given that JoblockPro's core functionality involves automated SMS messaging and telephony, the following additional terms apply:
19.1 TCPA Compliance Acknowledgment
YOU ACKNOWLEDGE AND AGREE THAT:
JoblockPro provides tools to send automated text messages and make automated calls to your customers on your behalf and at your direction
YOU are the "caller" or "sender" under the TCPA and similar laws, not JoblockPro
You are solely responsible for obtaining all required consents (including prior express written consent for marketing messages) before using the Service to contact your customers
You are solely responsible for maintaining proper consent records and producing them if required
JoblockPro provides consent management tools and opt-out processing as a convenience, but compliance responsibility rests entirely with you
Failure to comply with the TCPA can result in statutory damages of $500β$1,500 per unsolicited message, and JoblockPro shall bear no liability for such damages
19.2 10DLC and A2P Messaging Compliance
JoblockPro registers your messaging campaigns through approved 10DLC (10-Digit Long Code) and A2P (Application-to-Person) messaging channels in compliance with carrier requirements
You must provide accurate business information for campaign registration
You agree to comply with carrier messaging guidelines, CTIA best practices, and all applicable messaging regulations
Failure to comply may result in carrier filtering, message blocking, or account suspension by carriers β for which JoblockPro is not responsible
19.3 Message Delivery Disclaimer
JoblockPro does not guarantee the delivery of any SMS message, email, or voice call. Delivery depends on carrier networks, recipient device settings, spam filters, and other factors beyond our control. We are not liable for undelivered or delayed messages.
20. Service Level Expectations
20.1 Response Time
While we market our speed-to-lead response as "under 60 seconds," this represents an average target under normal operating conditions. Actual response times may vary due to:
High traffic volume
Third-party service latency (SMS carriers, email providers)
System maintenance windows
Integration delays

20.3 No SLA Guarantee
These are service level expectations, not contractual guarantees. Failure to meet these targets does not entitle you to credits, refunds, or damages unless separately agreed to in a written Service Level Agreement (available for Elite plan customers upon request).
